Terms and Conditions

TASPLATES ‘Share to WIN a $100 Visa Gift Card’ (COMPETITION) GAME OF SKILL 

  1. Information provided about how to enter and the prizes form part of these terms and conditions. By participating in the Competition entrants agree to be bound by these terms and conditions. Entries must comply with these terms and conditions to be valid.

    Total Competition period

  3.  The Competition commences at 09:00am AEDT on 20th February 2025 and ends at 17:00pm AEST on 19th August 2025 (Total Competition Period).

    Monthly Judging Dates and Announcement Dates:
     
  4. Month 1: 9:00am AEDT 20th February – 17:00pm AEDT 19th March. Judging date: 20th March (Winner announced by 31st March)
  5.  Month 2: 9:00am AEDT 20th March – 17:00pm AEST 19th April. Judging date: 21st April (Winner announced by 30th April)
  6. Month 3: 9:00am AEST 20th April – 17:00pm AEST 19th May. Judging date: 20th May (Winner announced by 31st May)
  7. Month 4: 9:00am AEST 20th May – 17:00pm AEST 19th June. Judging date: 20th June (Winner announced by 30th June)
  8. Month 5: 9:00am AEST 20th June – 17:00pm AEST 19th July. Judging date: 21st July (Winner announced by 31st July)
  9. Month 6: 9:00am AEST 20th July – 17:00pm AEST 19th August. Judging date: 20th August (Winner announced by 31st August)

    Eligibility to enter
     
  10. Entry is open to residents of Tasmania aged 18 years or over (Eligible Entrants).
  11. Eligible Entrants must be the registered owner of the TasPlates personalised number plate (Plate) submitted as part of the competition entry. A personalised number plate is defined as a plate where you have chosen your combination of letters and/or numbers.
  12. Directors, management, employees (including their immediate families* or those living in the same household), of the Promoter, and its respective affiliates, associated entities, subsidiaries and agencies associated with this Competition are ineligible to enter. 
    *Immediate family means spouse, ex-spouse, de-facto spouse, child or stepchild (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

    How to enter 

  13. To enter, Eligible Entrants must complete the below steps, during the Competition Period:
    1. Take a photo featuring your TasPlates
    2. Tell us why your TasPlates are special to you
    3. Submit your photo and story by email to hello@tasplates.com or, direct message your photo and story to the TasPlates Instagram or TasPlates Facebook pages.

  14. The total prize pool value is $600.00 (Prize).
  15. The Prize consists of the following: 
    1. 6 x Winners Prize: AUD$100.00 Visa Gift Card
  16. Each of the Winners Prizes, including any unused portion of same, is not transferrable or exchangeable, nor redeemable for cash, unless specified otherwise. 
  17. All taxes (excluding goods and services tax (GST) which may be payable as a consequence of receiving a prize are the sole responsibility of the winner.
  18. The Promoter is not liable for any loss, damage or injury suffered (even if caused by negligence) as a result of any winner accepting and/or using a prize, except for any liability which cannot be excluded by law.
  19. Each of the Winners Prizes, are awarded subject to any terms and conditions of Visa which may apply to the supply and use of Visa Gift Cards. Eligible Entrants are responsible for reviewing, understanding and adhering to such terms and conditions.   
  20. Eligible Entrants may only win one prize and may not win multiple prizes.
     
    Judging date and time
  21. Judging will take place at the Promoter's office, Suite 1401, Level 14, 124 Walker Street, North Sydney, NSW 2060 on the relevant judging date for each monthly competition period (Judging Date and Time)
  22. All entries will be judged individually and on their respective merits by a panel of three qualified judges with consideration for originality, sentimentality, literary and creative quality. 
  23. The best entry submitted will be chosen each month, as determined by the judges in their absolute discretion, will win the monthly Winners Prize.
  24. The Competition is a game of skill and chance plays no part in determining the winner.

    Winner notification
  25. Winners will be notified via email by 17:00pm AEST on the first business day following the judging day.
  26. Winners must acknowledge receipt of the Promoter’s email and claim their prize by replying to the notification, providing an email/postal address they would like their prize sent to, and providing any other information required by the Promoter. Winners must respond and provide all requisite information to the Promoter by no later than 17:00pm AEST 5 business days after being notified.
  27. Each month the winners will be announced on the TasPlates Facebook and Instagram pages.

    Unclaimed Prizes
  28. If for any reason a winner does not accept their prize by responding to the Promoter by 17:00pm AEST 5 business days after being notified the respective winner’s entry will deemed invalid and the prize will be forfeited. The Promoter will then be entitled to award any unclaimed prize(s) to the next best ranking entry or entries (as applicable), as determined by the judges or Promoter in its absolute discretion. 
  29. The Promoter is not obliged to offer a substitute prize or compensation to any winner that does not accept their prize and respond to the Promoter by 17:00pm AEST 5 business days after being notified.
  30. The Promoter will have no liability for any loss, damage or injury due to a winner's failure to receive notification emails as a result of technical or telecommunications problems, security breaches or settings, and the operation of the winner’s email account, including delivery of emails to spam or junk email inboxes, nor will the Promoter bear any liability for provision by a winner of incorrect or otherwise non-functioning contact information.

    Prize delivery

  31. The Prizes will be distributed by registered mail after the close of the Competition to the postal address provided by the winner to the Promoter.
  32. Any winners of unclaimed, redistributed prizes will be notified in writing by the Promoter.

    Prize substitution

  33. In the event any part of the Prize becomes unavailable for any reason beyond the Promoter’s control the Promoter may substitute the Prize (or any part thereof) with a prize of equal or greater value.                                                      

    Use of Eligible Entrant’s personal information

  34. Personal information, including the Eligible Entrant’s full name, address, telephone number, email, plate number and plate story will be collected and used by the Promoter for the purpose of conducting the Competition. Such information may also be disclosed to third parties, including local regulatory authorities and the Promoter’s agents or third party service providers, or for the purposes of promotion and marketing (including for direct marketing) (Purpose).
  35. By entering this Competition each Eligible Entrant consents to the use of their personal information for the Purpose, and to the Promoter contacting them for future marketing and material purposes without payment. Eligible Entrants agree that the Promoter may use their information for those purposes, and disclose it to other organisations, including overseas service providers.
  36. Eligible Entrants may access, change or update the personal information they provide to the Promoter by emailing the Promoter on hello@tasplates.com or by telephone at 1300 787 060 during office hours. A copy of the Promoter’s privacy policy is available at www.tasplates.com. The privacy policy contains information about how individuals may access or correct personal information or make a privacy related complaint.

    Entry content

  37. Entries must be the Eligible Entrant’s original work. The Promoter reserves the right to require the Eligible Entrant to verify that the entry is the Eligible Entrant’s original work. If the Promoter is unable to verify that the entry is original work to its satisfaction, the Promoter may, in its sole and absolute discretion, deem the entry to be invalid.
  38. Eligible Entrants warrant that their entry is not in breach of any third party intellectual property rights. Eligible Entrants agree to indemnify the Promoter and its associated agencies, directors, officers and employees against all losses, damages, claims and costs by third parties arising out of, connected to, or resulting from, a breach of the warranty set out in this clause 32.
  39. An Eligible Entrant’s entry must not include:
    1. any image, video or voice of any other person without that person’s express consent;
    2. any content that contravenes any law; and
    3. any content that is obscene, offensive, potentially defamatory, discriminatory, indecent, prejudicial or inconsistent with prevailing community standards.
  40. By entering the Competition Eligible Entrants grant the Promoter a non-exclusive licence to use the content of their entry, or any part of the content of the entry, in any way the Promoter wishes (including modifying, adapting, copying, cropping, retouching, editing, publishing, broadcasting or communicating the entry whether in original or modified form in whole or in part) in all media for the purposes of the Promoter’s business on its website, social media or in any marketing campaign, without payment to the Eligible Entrant of royalties or compensation. If requested by the Promoter, Eligible Entrants agree to sign any further documentation required by the Promoter to give effect to this clause 34.
  41. By entering this Competition Eligible Entrants consent to the Promoter dealing with their entry content in any way that may otherwise infringe the Eligible Entrant’s moral rights, and agree not to assert their moral rights (wherever such rights are recognised) in respect of their entry against the Promoter or its assigns, licensees or successors.
  42. Eligible Entrants consent to the Promoter using their name, likeness, image and/or voice in the event that they are a winner in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting this Competition (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the Promoter.

    Social media platforms

  43. By entering the Competition via a social media platform (including Facebook, X (formerly Twitter), Instagram, Snapchat or such other platform), Eligible Entrants:
    1. agree to comply with the terms of use of all such social media platforms;
    2. release such social media platforms from all claims based on, related to or arising from the Competition; and
    3. acknowledge and agree that this Competition is in no way sponsored or endorsed by or affiliated with such social media platforms. 
  44. The Promoter is not responsible for any loss, damage or injury to Eligible Entrants resulting from entering or participating in this Competition including arising from any comments made, or material published, by third parties about the Eligible Entrants on any social media platform in connection with this Competition.

    General conditions

  45. The Promoter’s decision is final and binding and no correspondence will be entered into. The Promoter accepts no responsibility for late, lost or misdirected entries or other communications. Entries will be deemed void if illegitimate, forged, manipulated or tampered with in any way.
  46. Should an Eligible Entrant’s contact details change during the Competition Period it is the Eligible Entrant’s responsibility to notify the Promoter. A request to access or modify any information provided as part of the redemption of a prize should be directed to the Promoter.
  47. The Promoter reserves the right to request verification of the social media profile of Eligible Entrants and of the age, identity and residential address of winners and any other information relevant to entry into or participation in this Competition. Verification is at the discretion of the Promoter, whose decision is final. Failure by the Promoter to enforce any of its rights does not constitute a waiver of those rights.
  48. The Promoter reserves the right to disqualify any individual who submits an entry that is not in accordance with these terms and conditions, or who is involved in any way in interfering or tampering with the conduct of this Competition, has breached any of these terms and conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Competition.
  49. Winners may have rights under the Australian Consumer Law and other similar legislation which cannot be excluded, restricted or modified by the Promoter. These terms and conditions do not exclude, restrict or limit those statutory rights in any way. However, to the extent that it is permitted to do so by law, the Promoter (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, special or consequential, arising in any way out of the Competition, including, without limitation:
    1. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
    2. any theft, unauthorised access or third party interference;
    3. any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
    4. any variation in market value to that stated in these terms and conditions;
    5. any tax implications (Eligible Entrants are encouraged to seek their own independent financial advice); or
      f. the Major Prize and Minor Prizes or use of the Major Prize and Minor Prizes.
  50. If for any reason beyond the reasonable control of the Promoter this Competition is not capable of running as planned, the Promoter reserves the right in its sole discretion to take any action that may be available to it, and to cancel, terminate, modify or suspend the Competition, or amend these terms and conditions, unless to do so would be prohibited by law.
  51. Eligible Entrants agree to indemnify the Promoter and its associated agencies, directors, officer and employees against all losses, damages, claims and costs by third parties arising out of, connected to, or resulting from, a breach of these terms and conditions.
